The Online Safety Act (OSA) 2023 has moved from legislative text to active enforcement. The Act establishes a statutory duty of care between platforms and service users, which covers user-to-user interactions and search tools that index and retrieve user content.
Ofcom is responsible for implementing and enforcing the Act and has listed more than 130 priority offences that organisations must assess and mitigate against, with a focus on child protection. Compliance is a matter of survival for law firms, both in terms of their internal compliance and advice that they provide. Ofcom now has the power to issue non-compliant companies with fines of £18million or 10% of qualifying worldwide revenue (whichever is greater).
This online classroom will set out what law firms must do to stay compliant. This includes how to evidence that risk assessments have been undertaken, and that mitigation measures are in place, as well as demonstrating proportionate measures to prevent dissemination of illegal content.
Subject matter expert, Laurence Howland, will outline how law firms can identify whether they are ‘in-scope’ of the legislation and, if so, what practical steps they must take to comply with the OSA 2023.
