Professional Ethics and Non-Disclosure Agreements in Employment Cases (by Max Winthrop) 

This course explains the key elements of the SRA Code of Conduct for employment matters, ethical issues in employment tribunal advocacy, and the use of non-disclosure agreements in employment documentation.

Employment Contract and Conditions  

By the end of this course, you will be able to: 

  • describe how contracts of employment are created 
  • understand the significance and contents of a section 1 statement of terms 
  • identify express terms and describe how terms may be implied into the contract of employment  
  • explain how the terms of the contract may be varied by the actions of the parties 
  • understand the ways in which collective bargaining may alter the terms of the contract 

Professional Ethics and Non-Disclosure Agreements in Employment Disputes  

By the end of this course, you will be able to: 

  • understand the elements of the SRA Code of Conduct that apply to solicitors acting in employment matters   
  • explain the issues that can arise when a solicitor is acting as an advocate in an employment tribunal   
  • understand the particular ethical problems that arise in using NDAs in employment matters  
  • describe the way in which the SRA’s warning notice and the Law Society’s practice note will apply in giving advice on and drafting the contents of NDAs
