The Solicitors Disciplinary Tribunal: Practice and Advocacy

The Solicitors Disciplinary Tribunal (SDT) adjudicates on applications and complaints brought against members of the solicitors’ profession and their employees. As a result, all solicitors should be aware of the nature of the SDT’s work, and the types of breaches that may come before it.

This short online course provides you with an overview of the SDT’s jurisdiction, procedures, and authority. Practitioners will gain valuable insights into the Tribunal’s role, including how it handles appeals of the SRA’s decisions and its power to impose sanctions where a breach is proven.

Through easy-to-understand chapters, this course provides insight into the types of breaches that come before the SDT and what happens after a referral is made. It will give you insights into the format of a hearing, as well as the defences and mitigations available for different types of breaches, from dishonesty through to recklessness, with reference to the relevant case law. Finally, it explores the consequences if a breach is proven, from fines to strike-offs, as well as the routes of appeal.

  • understand the jurisdiction of the Solicitors Regulation Authority and the Solicitors Disciplinary Tribunal (SDT), as well as some examples of what may be considered a breach
  • be able to identify the types of cases the SDT deals with, and how they come before the SDT
  • understand the procedures followed by the SDT after it receives a referral of a potential breach, as well as what happens at a hearing and when and how adjournments may be sought
  • be able to identify some of the most significant breaches that may come before the SDT, as well as the available defences and mitigation
  • be able to identify the different kinds of sanctions that the SDT can impose for breaches, as well as the consequences of these for solicitors and their firms
