Cross-Border Contracting and Compliance

This course will cover:

• recognition of e-signatures and digital contracts across jurisdictions
• localisation of governing law, jurisdiction, and enforcement clauses
• the process of digital execution, security and evidence
• dealing with ESG, modern slavery and supply chain due diligence in an international context
• management of cross-border risks and disputes
• identification of future trends and practical applications

By the end of this course, you will be able to:

• explain how electronic signatures and digital contracts are recognised and enforced under UK law and international frameworks
• draft and localise governing-law, jurisdiction and enforcement clauses in cross-border agreements
• identify and manage compliance obligations relating to ESG, modern slavery and supply-chain due diligence
• evaluate the risks and evidential challenges associated with digital execution and electronic storage
• apply practical approaches for allocating and mitigating risk in multi-jurisdictional contracts
• recognise emerging trends, including AI-driven and smart-contracting tools, that influence cross-border practice

Course format

This online course consists of the following elements:

• an interactive course presentation, with a variety of knowledge checks spaced throughout to test understanding of the material as the learner progresses
• an end-of-course assessment consisting of 10 questions

Assessment

In order to pass the assessment, you must achieve a pass mark of 70%.
