AI in Litigation: Key Issues and Considerations

Artificial intelligence (AI) is at the forefront of discussion around innovation in legal services. There are high levels of both enthusiasm and skepticism about the use and potential abuse of AI as well as significant pressure to keep up or get left behind.   

The profession’s response to AI is mixed, with enthusiastic adopters having been using AI-powered tools for long enough to have generated regulatory and court decisions which helps to navigate some of the risks and benefits of using AI tools for accuracy of advice, clarity of communication and processing of large volumes of claims and/or documents and data.

Learning outcomes

By the end of this online classroom, you will be able to:  

  • understand the regulatory duties engaged when you or your firm uses AI in litigation – even if such use is inadvertent 
  • understand how the courts and regulators use, authorise the use of and treat the use or misuse of AI in litigation 
  • respond appropriately when making or defending challenges surrounding the (alleged) use of AI in litigation 
  • ensure that AI use is identified, managed and, as far as possible, de-risked through education and effective policies and procedures 
How you will learn

Course format    

This online classroom consists of the following elements:    

  • an SME presentation with opportunities for interaction, delivered using Microsoft Teams    
  • an optional MCQ assessment, to obtain a certificate of completion    

Assessment  

In order to pass the assessment, you must achieve a mark of 80%.
